Resolution 2010-1
Re: Resolution In the Matter of Amending the 2010 Budget for the Columbia County Rural Library District for various Current Expense funds and Current Revenue.

WHEREAS, the Columbia County Rural Library District received an LSTA Indirect Federal Grant from the Washington State Library for the 2009 Rural Heritage Grant and for the 2009 Targeted Competitive Renew Washington grant; and

WHEREAS, it is deemed necessary to amend the 2010 budget with addition of grant funds from otherwise un-appropriated funds to complete the purchase of items requested in the original 2009 grants with monies being reimbursed to CCRLD from the Washington State Library for the LSTA grants; and

WHEREAS, un-budgeted revenue was received as follows:

 NOW, THEREFORE, BE IT HEREBY RESOLVED, that Columbia County Rural Library District Board of Trustees duly advertised the public budget hearing, which was held on January 28, 2010, and hereby direct those funds to be allocated accordingly.

Resolution 2010-2
A RESOLUTION AUTHORIZING THE ESTABLISHMENT OF A HEALTH REIMBURSEMENT ARRANGEMENT/VOLUNTARY EMPLOYEES’ BENEFICIARY ASSOCIATION (“HRA VEBA”) PLAN

WHEREAS, The Internal Revenue Code Section 501(c)(9) allows for the creation of a voluntary employees’ beneficiary association which is a tax-exempt health and welfare trust; and

WHEREAS, IRS regulations and guidelines allow an employer to offer health reimbursement arrangement (HRA) plans; and

WHEREAS, Such HRA plans are available to governmental employers in the Northwest; and

WHEREAS, The Voluntary Employees’ Beneficiary Association for Public Employees in the Northwest Trust (“Trust”) offers and will administer an HRA entitled “Voluntary Employees’ Beneficiary Association Medical Expense Plan for Public Employees in the Northwest as Amended and Restated January 1, 2007” (“Plan”); and

WHEREAS, Columbia County Rural Library District (“Employer”) has determined that establishing an HRA plan which provides a tax-free defined contribution account for employees to pay for medical, dental, vision, and tax qualified long-term care premiums and non-covered healthcare expenses is in the best interest of the Employer and its employees; and

WHEREAS, The Employer desires to establish an HRA plan for its employees; and

WHEREAS, The Employer desires to use the services of the Trust to administer such Plan; and

WHEREAS, Such HRA established by the Employer will be administered in accordance with the Plan documents provided by the Trust on file in the Columbia County Auditor’s Office.

IT IS HEREBY RESOLVED BY THE BOARD OF COLUMBIA COUNTY RURAL LIBRARY DISTRICT the following:

Section 1: Effective March 25, 2010, Employer, Columbia County Rural Library District, hereby elects to participate in the Plan and Trust as presently constituted or hereafter amended using the Trust as its plan administrator for the benefit of eligible employees as defined by Employer policy. Disbursement of funds will be executed by the Columbia County Auditor’s Office in April, 2010 for the May premium payment.

Section 2: The Plan will be funded with Employer contributions in amounts determined from time to time pursuant to Employer policies.

Section 3: The Columbia County Rural Library District Board of Trustees and the Director are authorized to execute documents and establish procedures consistent with Plan and Trust provisions and applicable Employer policies necessary to effect the adoption and administration of the Plan.

Resolution 2010-3
RE: RESOLUTION OF THE COLUMBIA COUNTY RURAL LIBRARY DISTRICT BOARD OF TRUSTEES, COLUMBIA COUNTY, WASHINGTON, REVISING A TOBACCO RESOLUTION ORIGINALLY ADOPTED OCTOBER 22, 2009

WHEREAS, for health and safety reasons, Columbia County Rural Library District prohibits the use of ALL tobacco by all personnel and patrons in County Library District facilities or vehicles (if there are any), which includes but is not limited to
Dayton Memorial Library building, Delany room, office, basement areas and the grounds outside on which the library building is located.

NOW, THEREFORE, BE IT RESOLVED, smoking or other tobacco products will not be allowed in or on County Library District facilities or vehicles (if any).

RE: RESOLUTION OF THE COLUMBIA COUNTY RURAL LIBRARY DISTRICT ESTABLISHING A DISABILITY DISCRIMINATION: “NO TOLERANCE” POLICY

WHEREAS, Columbia County Rural Library District prohibits and does not tolerate discrimination against any qualified individual with a disability. A qualified individual with a disability is anyone who can perform the essential functions of the job with or without reasonable accommodation for his or her disability.

WHEREAS, All qualified individuals with a disability are guaranteed the same employment opportunities as other employees or applicants. No person or employee, no matter his or her title or position, has the authority, whether expressed, actual, apparent, or implied, to discriminate against a qualified employee or applicant with a disability.

WHEREAS, Columbia County Rural Library District Director will make all decisions concerning recruitment, placement, selection, training, hiring, advancement, discharge or other terms, conditions, or privileges of employment based on job-related qualifications and abilities.

NOW, THEREFORE, BE IT RESOLVED, Columbia County Rural Library District prohibits any verbal, physical, or visual conduct that belittles or demeans any qualified individual with a disability.

RE: RESOLUTION OF THE COLUMBIA COUNTY RURAL LIBRARY DISTRICT ESTABLISHING TRAVEL REIMBURSEMENT

WHEREAS, Columbia County Rural Library District recognizes that County Library employees in carrying out authorized responsibilities incur certain expenses;

NOW, THEREFORE BE IT RESOLVED, The Columbia County Rural Library District Board of Trustees approves the reimbursement of such necessary and reasonable expenditures as outlined under administrative procedures.

Resolution 2010-7
RE: WEAPONS IN THE WORKPLACE: “NO TOLERANCE”

WHEREAS, Columbia County Rural Library District strictly prohibits and does not tolerate weapons in the County Library District facilities or ground, the carrying of firearms is limited to law enforcement officers and those involved in court security.

NOW, THERFORE BE IT RESOLVED, Weapons include visible and concealed weapons, including those for which the owner has necessary permits. Weapons can include firearms, knives with a blade longer than three (3) inches, explosive materials, or any other objects that could be used to harass, intimidate, or injure another individual employee, supervisor, Director, patron or Trustee.

PASSED AND ADOPTED by the Columbia County Rural Library District Board of Trustees, this 27th day of July 2010 to comply with policy adopted September 24, 2009.

RE: RESOLUTION OF THE COLUMBIA COUNTY RURAL LIBRARY DISTRICT ESTABLISHING A WORKPLACE WRONGDOING: “NO TOLERANCE” POLICY

WHEREAS, Columbia County Rural Library District does not tolerate workplace wrongdoing on County premises, property, while driving County owned vehicles, or while acting within the scope of employment; and

WHEREAS, Columbia County Rural Library District does not tolerate theft of property, whether from the employer, public, or from a co-worker. Employees should seek permission before removing County Library material, tools, or other items, including damaged goods or any other material from prescribed storage or use locations; and

WHEREAS, Columbia County Rural Library District prohibits false information on any expense account sheet or on any insurance claim submitted under the County’s health care benefits or workers’ compensation benefits program; and

WHEREAS, Columbia County Rural Library District prohibits fighting, horseplay, practical jokes, and pranks on its premises, any employee who instigates physical violence, or threatens physical violence, may be subject to disciplinary action, up to immediate discharge; and

WHEREAS, Columbia County Rural Library District prohibits embezzlement or stealing of County Library funds, employee or customer funds, including but not limited to, stealing money from a County account, stealing postage or unlawful use of telephone privileges; and

WHEREAS, Columbia County Rural Library District prohibits gambling in the County’s facility or on County property including placing and/or taking bets; and

WHEREAS, Columbia County Rural Library Distrist prohibits speeding, following too close, negligent driving and other traffic infractions while driving a County owned vehicle (if County Library District owns their own vehicle);

NOW, THEREFORE, BE IT HEREBY RESOLVED, that any employee who violates this policy may be subject to disciplinary action, up to and including immediate discharge.

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE COLUMBIA COUNTY RURAL LIBRARY DISTRICT, COLUMBIA COUNTY, WASHINGTON INCREASING MEDICAL EMPLOYER PAID BENEFIT FROM $538 TO $572 PER MONTH

WHEREAS, it has come to the attention of the Columbia County Rural Library District Board of Trustees that the medical insurance has increased and that the employer paid benefit for medical insurance needs to increase for Columbia County Rural Library District employees from $538 to $572 per month based upon a full-time position, and

WHEREAS, The Board of the Columbia County Rural Library District believes that the employer paid medical benefit of $572 per month is fair and equitable, the Library Board of Trustees would like to set the Columbia County Rural Library District Employees’ employer paid medical benefit at $572 per month for a 38-40 hour position; $429 for a 30-37 hour position (75% of $572); and $343 for a 25-29 hour position (60% of $572), and

NOW, THEREFORE, BE IT RESOLVED, that the County Auditor is authorized to pay employer paid medical benefits at $572 for a 38-40 hour per week position; $429 for a 30-37 hour per week position; and $343 for a 25-29 hour per week position effective for the January 2011 benefits and that this resolution rescinds and supersedes any prior resolution or directive from the Board of the Columbia County Rural Library District.

BE IT FURTHER RESOLVED, that the medical employer paid benefit may only be changed at the beginning of the year, provided that said rate is within budgetary limits and in accordance with Columbia County Rural Library District Board of Trustees resolution.

WHEREAS, the Board of Trustees of Columbia County Rural Library District has met and considered its budget for the calendar year 2011; and

WHEREAS, the districts actual levy amount for the previous year was $_189,000____; and,

WHEREAS, the population of this district is ____ more than or ___X__ less than 10,000 and now, therefore,

BE IT RESOLVED by the governing body of the taxing district that an increase in the regular property tax levy is hereby authorized for the levy to be collected in the ___2011_______ tax year.

The dollar amount of the increase over the actual levy amount from the previous year shall be $_8,093 which is a percentage increase of 1.0428_% from the previous year. This increase is exclusive of additional revenue resulting from new construction, improvements to property, newly constructed wind turbines, any increase in the value of state assessed property, any annexations that have occurred and refunds made.
